
Terms of Service
This is an English translation provided for convenience. In case of any discrepancy in interpretation, the original Korean version shall prevail. These terms set out the conditions and procedures for using the services provided by Kim Hyun Soo Internal Medicine Clinic (the ‘Clinic’), together with other necessary matters, in accordance with the Telecommunications Business Act and its Enforcement Decree.
Article 1 (Purpose)
- ① These terms set out the rights, obligations and responsibilities of members and the Clinic in relation to the use of the internet services provided by the Clinic (the ‘Services’).
- ② A person who wishes to become a member is deemed to agree to these terms upon completing the prescribed procedure and pressing the ‘Sign up’ button. Matters not set out in these terms are governed by the Telecommunications Business Act, other applicable laws and commercial practice.
Article 2 (Definition of member)
A ‘member’ is a person who accesses the Clinic’s website, registers as an online member under these terms, and uses the Services provided by the Clinic.
Article 3 (Membership registration)
- ① A person who wishes to become a member applies by entering their information in the registration form set by the Clinic and pressing the ‘Sign up’ button.
- ② The Clinic registers an applicant as a member unless any of the following applies.
- 1. The applicant has previously lost membership status (except where three years have passed since the loss of status and the Clinic has consented to re-registration)
- 2. The registration details contain false information, omissions or errors
- 3. Registering the member is judged to cause significant technical difficulty for the Clinic
- ③ The membership agreement is formed at the point the Clinic’s acceptance reaches the applicant.
- ④ Members must correct their registered information promptly whenever it changes.
Article 4 (Provision and change of Services)
- ① The Clinic provides members with the following Services.
- 1. The Clinic’s newsletter email service
- 2. Online consultation and appointment services
- 3. Sections and content services for online members
- 4. Other services provided by the Clinic in partnership with third parties
- ② The Clinic may change the Services it provides, giving notice of the content of the change and the date it takes effect by the method set out in Article 7(2).
Article 5 (Suspension of Services)
- ① The Clinic may suspend the Services temporarily where information and communications equipment requires maintenance, inspection or replacement, or where equipment fails or communications are interrupted, and may discontinue the current Services entirely for reasons it considers appropriate.
- ② Where the Services are suspended, the Clinic gives notice by the method set out in Article 7(2). This does not apply where advance notice is impossible because of a cause beyond the Clinic’s control, such as a disk failure or system outage.
Article 6 (Withdrawal and loss of membership)
- ① Members may request cancellation of their registration (withdrawal) at any time, and the Clinic proceeds with the withdrawal immediately upon request.
- ② The Clinic may restrict, suspend or withdraw membership status where a member falls under any of the following.
- 1. The member registered false information when applying
- 2. The member threatens the order of electronic commerce, for example by obstructing another user’s use of the Services or misappropriating information
- 3. The member acts in a way prohibited by law or these terms, or contrary to public order and morals
- ③ Where the Clinic decides to withdraw membership status, it cancels the registration, giving notice beforehand and an opportunity to respond.
Article 7 (Notices to members)
- ① Notice to an individual member may be given to the email address registered with the Clinic.
- ② Notice to members generally may replace individual notice by being posted on the Clinic’s notice board for at least one week.
Article 8 (Protection of members’ personal information)
The Clinic endeavours to protect members’ personal information as required by applicable law. Matters concerning the protection of personal information are governed by applicable law and by the Clinic’s Privacy Policy.
Article 9 (Obligations of the Clinic)
- ① The Clinic does not act in any way prohibited by law or these terms, or contrary to public order and morals, and endeavours to provide the Services continuously and reliably.
- ② The Clinic maintains a security system to protect personal information (including credit information) so that members can use the Services safely.
- ③ The Clinic does not send commercial advertising email that members have not asked to receive.
Article 10 (Obligations regarding member IDs and passwords)
- ① Except where the Clinic is responsible under applicable law or the Privacy Policy, each member is responsible for managing their own ID and password.
- ② Members must not allow a third party to use their ID or password.
- ③ Members who become aware that their ID or password has been stolen or is being used by a third party must notify the Clinic immediately and follow its instructions.
Article 11 (Obligations of members)
① Members must not engage in any of the following.
- 1. Registering false information when applying for or changing membership
- 2. Altering information posted by the Clinic
- 3. Infringing the personal rights or intellectual property rights of the Clinic or a third party, or obstructing their business
- 4. Misappropriating another member’s ID
- 5. Posting information contrary to public order and morals, such as spam, junk or chain messages, or obscene or violent messages
- 6. Transmitting or posting information whose transmission or posting is prohibited by law
- 7. Posting or sending content while impersonating Clinic staff or an administrator, or under another person’s name
- 8. Posting or sending material intended to disrupt or destroy normal operation, such as computer viruses
- 9. Harassing other members, including stalking
- 10. Collecting, storing or disclosing another member’s personal information without consent
- 11. Using the Clinic’s Services for commercial gain
- 12. Otherwise breaching the rules on use of the Services
- ② Where a member engages in conduct under paragraph 1, the Clinic may restrict, suspend or withdraw their membership status under Article 6(2) and (3).
- ③ Members are liable to compensate the Clinic or other members for loss caused by their own fault.
Article 12 (Deletion of public postings)
Where a member’s public posting falls under any of the following, the Clinic may delete it without prior notice and may restrict, suspend or withdraw the member’s status.
- 1. Content that defames or slanders another member or a third party and damages their reputation
- 2. Content that circulates information, text or images contrary to public order and morals
- 3. Content judged to be connected with criminal conduct
- 4. Content that infringes the copyright or other rights of another member or a third party
- 5. Content that is predominantly advertising or commercial in nature
- 6. Other content judged to breach applicable law
Article 13 (Ownership of copyright and restrictions on use)
- ① Copyright and other intellectual property rights in works created by the Clinic belong to the Clinic.
- ② Members must not use information obtained through the Services for commercial gain, or allow a third party to do so, by reproducing, transmitting, publishing, distributing or broadcasting it without the Clinic’s prior consent.
Article 14 (Provisions on consultations)
- ① The content of consultations conducted through the Services may be used for the following purposes after personally identifying information has been removed.
- 1) Academic activities
- 2) Clinical activities
- 3) Medical services
- 4) Authoring activities, including print materials and CD-ROMs
- 5) Parts of the Services such as FAQs and featured consultations
- ② The Clinic may decline to provide consultation services in whole or in part in the following cases.
- 1) Repeated requests for consultation on the same matter
- 2) Requests using expressions contrary to common sense, or profanity
- 3) Requests seeking a diagnosis
- 4) Requests concerning treatment fees, test fees, medicine prices or effects
- 5) Requests made to obtain information in order to harm another person
Article 15 (Amendment of these terms)
- ① The Clinic may amend these terms to the extent that doing so does not breach applicable law, including the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Commerce, the Digital Signature Act and the Act on Promotion of Information and Communications Network Utilisation.
- ② Where these terms are amended, the effective date and the reason for the amendment are announced on the initial screen, together with the current terms, from seven days before the effective date until the day before it.
- ③ Amended terms apply to members who registered before the amendment as well, unless doing so breaches applicable law.
- ④ A member who objects to the amended terms may withdraw under Article 6(1).
Article 16 (Jurisdiction)
Any action arising from a dispute between the Clinic and a member concerning use of the Services shall be brought before the court in the Republic of Korea having jurisdiction under the Civil Procedure Act.
Supplementary provision — These terms apply from 1 July 2020 until new terms take effect.
